In these data protection regulations, medK presents its approach to the data collected from users who access our website at www.med-k.com ("website") or who provide us with personal data in another way (collectively: "user").

Storage of personal Data

We store your personal data for as long as is necessary to provide our services, comply with legal obligations, resolve disputes and enforce our policies. The retention periods depend on the type of data collected and the purpose for which this data was collected, taking into account both the case-specific circumstances and the need to delete outdated, unused information as soon as possible. We store records with personal data from customers, documents about the account setup, messages and other data in accordance with applicable laws and regulations.

 

We can correct, complete or remove incomplete or incorrect data at any time and at our sole discretion.

 

Basis for Data acquisition

The processing of your personal data (i.e. any data that can reasonably be used to identify you; "personal data") is necessary in order to fulfill our contractual obligations to you and so that we can provide you with our services and protect our legitimate interests.

What kind of data is recorded?

Furthermore we hold a statistic of this data in anonymised form regarding the intention of requests and the inquired products to be able to continuously enhance our portfolio. This website uses the open-source mapping tool “OpenStreetMap” (OSM) map service to display interactive maps, operated by the OpenStreetMap Foundation, 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom.

By using OpenStreetMap, your IP address is sent to an OpenStreetMap Server and stored there. We cannot influence the scope of the data collected in this way. We have no influence on the further processing and use of data by OpenStreetMap and can therefore accept no responsibility for this.


The use of OpenStreetMap is in the interest of making our site appealing and to facilitate the location of places specified by us on this website, which constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO. YouTube

For embedding videos on our website, we use the provider YouTube. Like most websites YouTube uses cookies to collect information about the visitors of its website. Amongst others YouTube uses those to compile video statistics, to avoid fraud and to optimise ease of use. Furthermore, this connection results in a connection with the Google DoubleClick network. When you start a video, your action can evoke further data process action on which we have no influence. Use of script libraries (Google Web Fonts)

We use script and font libraries such as Google Web Fonts (https://www.google.com/webfonts) for this website so that our content is displayed correctly and graphically appealing in every browser. Google Web Fonts are transferred to your browser's cache so that they only have to be loaded once. If your browser does not support Google Web Fonts or denies access, the content will be displayed in a standard font.

       When calling up script or font libraries, a connection to the library operator is automatically established. There is a theoretical possibility for this operator to collect data. It is currently not known whether and for what purpose the operators of the relevant libraries actually collect data.

Newsletter Subscription

Our newsletter is distributed via “MailChimp”, a newsletter shipping platform of Rocket Science Group, LLC, 675 Ponce De Leon Avenue 5000, Atlanta, GA 30308, USA. The e-mail addresses of our Newsletter recipients, as well as their other information described in these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletters on our behalf. Furthermore, MailChimp may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the shipping and the presentation of the newsletter or for economic purposes, to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write them down or to pass them on to third parties. We rely on the reliability, IT and data security of MailChimp. MailChimp is certified under the US-EU privacy shield “Privacy Shield” and is committed to complying with EU data protection requirements. Furthermore, we have concluded a data processing agreement with MailChimp. This is a contract in which MailChimp pledges to protect the data of our users, to process it in accordance with its privacy policy on our behalf and, in particular, not to disclose it to third parties. Our newsletter contains information about medK, events, its products and portfolio updates hat are relevant to medK target groups. We send newsletters only with the consent of the recipient or a legal permission. Insofar as the contents of a newsletter are concretely described, they are authoritative for the consent of the users.


The registration for our newsletter takes place in a so-called double opt-in procedure, meaning that after registration, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can register with external e-mail addresses. The registration for the newsletter will be logged in order to prove the registration process according to the legal requirements. This includes the storage of the login and the confirmation time, as well as the IP address. Similarly, the changes to your data stored with MailChimp will be logged.


To subscribe to the newsletter, it is sufficient to enter your e-mail address. Optionally, we ask you to provide your first and last name. This information is only for the personalization of the newsletter.

 

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. This call will initially collect technical information, such as information about the browser and your system, as well as your IP address and time of retrieval. This information is used to improve the technical performance of services based on their specifications or audience and their reading habits, based on their locations (which can be determined using the IP address) or access times. Statistical surveys also include determining if the newsletters will be opened, when they will be opened and which links will be clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our desire nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.


There are cases in which we direct the newsletter recipients to the MailChimp websites. For example, our newsletters contain a link that allows newsletter recipients to retrieve newsletters online (for example, in the case of display problems in the e-mail program). Furthermore, newsletter recipients can change theirs stored data, such as correct the e-mail address later. Accordingly, the privacy policy of MailChimp is only available on their page. In this context, we point out that on the websites of MailChimp cookies are used and thus personal data processed by MailChimp, their partners and service providers used (such as Google Analytics). We have no influence on this data collection. For more information, see the privacy policy of MailChimp. You can terminate the receipt of our newsletter at any time, i.e. revoke your consent. At the same time, your consent to sending it via MailChimp and the statistical analyses will expire. A separate revocation of the dispatch via MailChimp or the statistical evaluation is unfortunately not possible. A link to cancel the newsletter can be found at the end of each newsletter.


In accordance with the provisions of the Data Protection Regulation (DSGVO) from 25 May 2018, we inform you that the consents to the sending of e-mail addresses are based on Art. 6 para. 1 lit. a, 7 DSGVO and § 7 (2) no. 3 and (3) UWG. The use of the mail service provider MailChimp, carrying out the statistical surveys and analyses as well as logging the registration process, are based on our legitimate interests in accordance with. Art. 6 para. 1 lit. f DSGVO. We are interested in using a user-friendly and secure newsletter system that serves both our business interests and the expectations of our users. We further point out that you can contradict the future processing of your personal data in accordance with the statutory requirements Art. 21 DSGVO at any time. The objection may in particular be made against processing for direct marketing purposes.


Corporate transaction

We may pass on data in the event of a corporate transaction (e.g. the sale of significant parts of the company, a merger, consolidation or sale of assets). If one of the above-mentioned cases occurs, the acquirer or the corresponding company assumes the rights and obligations set out in this data protection declaration.
